Please read these Terms & Conditions carefully before accessing, advertising or using this site. By accessing or using www.ArchiStaff.com.au you ("Users" and "Advertisers") agree to be bound by the following Terms & Conditions. We reserve the right to change the website and the Terms & Conditions from time to time without notice, so please review these Terms & Conditions each time you use the site.
ArchiStaff.com.au is a web site owned by All Recruitment Ltd (ACN 116 506 971) ("ArchiStaff.com.au"). This web site is intended to provide Users and Advertisers with general information and services and as such, Users and Advertisers must abide by and agree to the Terms & Conditions set out below:
Use of the Web Site
You agree:
- To use the web site for lawful purposes only.
- That information and images provided, and advertisements posted to the site, by Users and Advertisers are accurate, true and not misleading:
- Jobs must be posted only for jobs that are current and legitimate at the time of posting. Jobs on ArchiStaff.com.au must be removed as soon as the positions are filled or for any reason are no longer current.
- Job seekers and contractors posting resumes and contract profiles must ensure that their resume or contractor profile is posted to the correct categories, the correct locations, and that all other information and images are correct and accurate.
- Advertisers posting jobs must ensure that advertisements are posted to the appropriate categories and location, and that all other information and images are correct and accurate.
- That information and images provided, and advertisements posted to the site, by Users and Advertisers are not discriminatory, offensive, illegal, unlawful, defamatory, libellous, abusive or in breach of any laws of Australia, or of any other relevant jurisdiction.
- That information and images provided, and advertisements posted to the site, by Users and Advertisers will not encourage or constitute a criminal offence, result in civil liability or breach any legislation, regulations or code of practice.
- That information and images provided, and advertisements posted to the site, by Users and Advertisers do not infringe any intellectual property rights of any person. This includes but is not limited to trade marks, logos, copyrights, moral rights, trade names, patents, and trade secrets.
- That Advertisers comply with the Human Rights and Equal Opportunity Commission Act 1986 and Regulations, and all other anti-discrimination and equal opportunity legislation.
- That Users and Advertisers comply with the National Privacy Principles set out under the Privacy Act Amendment (Private Sector) Act 2000:
- That Advertisers will not identify themselves, or identify or advertise any website or email address in any content outside of the prescribed fields.
Intellectual Property
All intellectual property rights in any material, documentation or content on this web site is the property of ArchiStaff.com.au, including but not limited to domain names, logos, copyrights, trade names and trade marks. Trade marks, trade names and logos of clients and third parties are the property of those parties.
Users and Advertisers do not have the right to use these intellectual property rights without written permission by ArchiStaff.com.au.
Disclaimers and limitations on liability
ArchiStaff.com.au does not make any representation whatsoever about any resume, job or contractor profile advertised on the site, nor about any of the Advertisers. Users and Advertisers of ArchiStaff.com.au are required to satisfy themselves as to the suitability of any agency, employer, contractor, job, or resume found directly or indirectly through this site.
ArchiStaff.com.au reserves the right to either reject or remove any job posting, contract listing, contractor profile listing, or resume from its site for any reason whatsoever, including any advertisement or listing that is in breach of any law.
ArchiStaff.com.au provides no warranty to Advertisers that services available through the site will be uninterrupted or error free. ArchiStaff.com.au agrees to use its reasonable endeavours to ensure that any disruptions to or a denial of access to its site will be remedied as quickly as possible.
ArchiStaff.com.au will use its reasonable endeavours to avoid errors in advertisements and listings it has agreed to post to the site. However, ArchiStaff.com.au accepts no responsibility or liability for any errors and requires that Users and Advertisers check their listings for errors as soon as they are placed on the ArchiStaff.com.au site.
Users and Advertisers accept that ArchiStaff.com.au cannot and does not screen, vet, or QA all jobs, resumes, and contractor profiles posted on the site. ArchiStaff.com.au will do its best to ensure a high level of quality and accuracy, however, ArchiStaff.com.au is not responsible for the validity or accuracy of information and images contained in these postings. ArchiStaff.com.au will not be liable for any loss, costs, damages or loss of profits sustained as a consequence of any User or Advertiser employing or engaging any person sourced through ArchiStaff.com.au, or any job, contract, or freelance work sourced through ArchiStaff.com.au.
ArchiStaff.com.au cannot and does not guarantee or warrant to the User or Advertiser that files available on or emailed through the site will be free of infection or viruses, worms, trojan horses or other malicious or harmful code. ArchiStaff.com.au will not be liable to you for any direct, indirect, consequential, special or other damage resulting from the transmission from this website to your computer systems of viruses, worms, trojan horses or other destructive items, however caused, such damage to include, without limitation, loss of profits, interruption to business, loss of the whole or any part of a programme or any data howsoever stored whether saved on a computer system or otherwise.
Indemnity
Advertisers and Users agree to indemnify ArchiStaff.com.au, its officers, employees and agents against all claims, actions, suits, liabilities, any actual or contingent costs, expenses, charges or damages incurred on any account by ArchiStaff.com.au arising from:
- The listing or proposed listing by an Advertiser or the posting or uploading of information or images by a User on ArchiStaff.com.au or any related site.
- Any breach of this agreement by an Advertiser or User.
- Any negligent act or omission by an Advertiser or User.
- An actual or alleged breach of any law, legislation, regulation, by-laws, ordinances or codes of conduct which occurs as a consequence of information or images that the Advertiser or User has posted or uploaded to the site.
Privacy
Access to the profile details of job seekers in the resume database is available only to approved ArchiStaff.com.au Advertisers who have registered and paid for access to the resume database. Names and contact details of job seekers will not be provided to Advertisers without their prior consent.
Advertisers may access and use the information and images stored on the database solely for the purpose of identifying candidates for current or forthcoming job vacancies. Advertisers must not use a job seeker's resume or contact details for any purpose other than to help that person find a job. Breach of this clause may result in the Advertiser's ArchiStaff.com.au membership being cancelled.
Advertisers agree that ArchiStaff.com.au may, for the purposes of assessing an Advertiser's commercial credit application, obtain from either a credit reporting agency or other credit providers, personal credit information about the Advertiser and/or its directors or a consumer credit report about the Advertiser from a credit reporting agency for the purposes of collecting overdue payments relating to commercial credit owed by the Advertiser.
ArchiStaff.com.au reserves the right to edit, re-categorise, change or update a job or project posting, resume, or freelance profile at any time. This is generally done to correct mistakes or omissions made by the User or Advertiser.
General
Recruitment firms are excluded from utilising this web site. We reserve the right to reject or remove any job posting, contract listing, contractor profile listing, or resume from its site for any reason whatsoever, including any advertisement or listing that is in breach of any law.
ArchiStaff.com.au may, at its discretion and without further cost or notice to the User or Advertiser, partner with or syndicate job, resume, or contractor data to other third party organisation's employment sites. Details of any partner or syndicate employment sites will always be listed on the ArchiStaff.com.au site.
Users and Advertisers will not use the site to post any advertisement, listing, or any information relating to pyramid schemes. Users and Advertisers also agree not to ask or require any Job Seeker to pay a fee or any money whatsoever to apply for any job advertised on the ArchiStaff.com.au site.
Users and Advertisers will not use any feature of ArchiStaff.com.au to send unsolicited emails, to any person or business for any reason. Legitimate communication tools provided within ArchiStaff.com.au for the purpose of communicating with employers and job seekers are the exception to this rule.
Advertisers may not assign or transfer any rights and obligations pursuant to this agreement to any other person or entity without ArchiStaff.com.au's prior written approval. Approval will not be unreasonably withheld.
If an Advertiser, any associated company or subsidiary appoints a Job Seeker in either a permanent or contract capacity a fee will apply as per our fee structure. In the event that a contractor is employed on a permanent basis, a permanent fee will apply as per our fee structure.
All amounts owing to All Recruitment Ltd ("ArchiStaff.com.au") must be paid within 14 days of the date of invoice/transaction. Payment becomes due when a job seeker introduced by All Recruitment Pty Ltd ("ArchiStaff.com.au") accepts an offer of employment from the Advertiser.
Refunds on credit card payments will be made at the discretion of management.
ArchiStaff.com.au will be entitled to a fee where a Job Seeker is placed directly with an Advertiser or is introduced by the Advertiser to a third party resulting in a contract assignment or permanent placement. Where a Job Seeker has undertaken an assignment with the Advertiser, this clause applies up to one year from completion of the assignment. Where the Job Seeker has not undertaken an assignment with the Advertiser, this clause applies up to one year from the date of initial introduction.
"Work from home" or "Business Opportunity" advertisements are allowed only under the following conditions:
- The business must be based in Australia.
- Opportunities must not require any up front fee or payments of any kind.
- The exact nature of the opportunity must be clearly specified in the ad. Vague descriptions or links to vague web sites are definitely not allowed. Any job or project listings that we think breaches these conditions may be removed at any time without warning or notification.
This agreement is governed by the laws of New South Wales. Users and Advertisers irrevocably and unconditionally submit to the non-exclusive jurisdiction of the Courts of New South Wales, and waive any objection to legal action being brought in those Courts on the grounds of venue or inconvenient forum.
